In response to your inquiry. As a filing official, the Secretary of State does not determine qualification or eligibility of candidates. The Secretary of State's Office is ministerial in its duties. Our office has no legal authority to investigate the qualifications of a candidate or the information a candidate provides on his/her filing forms. For further guidance on challenging a candidate's qualifications, you may want to review Kentucky Revised Statute, Section 118.176. You can locate these statutes at: www.lrc.ky.gov. Click on Kentucky Laws, then choose the 'Title/Chapter' option and scroll down to 'Chapter 118'. You should be able to locate the previous mentioned statute there.

The whole point of the current constitutional crisis is in the fact that nobody checked the eligibility of the candidates. Please see Donofrio v Wells. This case is the second case in front of the Supreme court. Just like with any other state in the union, Nina Wells, Secretary of State of NJ completely abandoned her duties and posted on the ballot in NJ names of the candidates simply based on their statement, that they are eligible. Aside from Mr. Obama, who absolutely arrogantly refuses to release his Vault (long version) birth certificate, most probably created upon the statement made by his grandparents; NJ ballot also featured another candidate, that admitted to being born in Nicaragua. The secretaries of States that took the oath of office to uphold the constitution, are outrageously trampling on it, aiding and abeting fraud, that is a felony and is punishable by jail term, this behavior is bordering on treason. I have written a draft of the letter(draft #3) to be sent from We the People foundation to each and every law enforcement agency in each and every state, to each Governor, each secretary of State, each elector, each Congressman, Each Senator, each judge. it is in the attachment,I need an o'k from Bob Schultz to send it to"

If The Supreme Court Decides ...?
At this point, Supreme Court Justice David Souter's Clerk informed Philip J. Berg, the lawyer who brought the case against Mr. Obama, his petition for an injunction to stay the Nov. 4 election was denied, but the clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by Dec. 1. At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.

If Mr. Obama fails to do that, it is sure to inspire the skepticism of the justices, unaccustomed to being defied. They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.

"I can see a unanimous court (en banc) decertifying the election if Obama refuses to produce his birth certificate," says Raymond S. Kraft, an attorney and writer. "They cannot do otherwise without abandoning all credibility as guardians of the Constitution ..."

Also remember on Dec. 13, the Electoral College meets to casts its votes. If it has been determined Mr. Obama is an illegal alien and therefore ineligible to become President of the United States, the electors will be duty-bound to honor the Constitution.

Two of the plaintiffs in court cases against Sen. Barack Obama, the president-elect, are working to move their cases forward before his presidential inauguration.

Philip J. Berg, the attorney who filed suit against Mr. Obama challenging him to produce his original birth certificate to prove he meets the constitutional requirements to serve as U.S. president. Mr. Berg filed a Writ of Certiorari in the U.S. Supreme Court late in October, in an effort to force Mr. Obama to produce the document.

Accordingly, the U.S. Supreme Court has said that Mr. Obama, the DNC and all co-defendants are to respond to the writ, on or before Dec. 1."

For example, I had thought for many months that the flap over Obama's birth certificate was a tempest in a teapot. But simple questions about the certificate were never resolved to my satisfaction. Thanks to their own blathering, fanatical overkill, of course, the right-wing challenges to the birth certificate never gained traction.

But Obama could have ended the entire matter months ago by publicly requesting Hawaii to issue a fresh, long-form, stamped certificate and inviting a few high-profile reporters in to examine the document and photograph it. (The campaign did make the "short-form" certificate available to Factcheck.org, a project of the Annenberg Public Policy Center at the University of Pennsylvania.) And why has Obama not made his university records or thesis work widely available? The passivity of the press toward Bush administration propaganda about weapons of mass destruction led the nation into the costly blunder of the Iraq war. We don't need another presidency that finds it all too easy to rely on evasion or stonewalling. I deeply admire Obama, but as a voter I don't like feeling gamed or played.
